These Terms and Conditions (“Terms”) govern your use of the Off Agent platform operated by OFF AGENT LTD (Company Number 13732300), registered office: Lower Wootton House, Wootton, Almeley, Hereford, HR3 6PX (“Off Agent”, “we”, “us”, “our”).
By creating an account, listing a property, subscribing to any paid service, or using the platform in any way, you agree to be legally bound by these Terms.
If you do not agree, you must not use the platform.
Off Agent is a property listing platform only.
We:
Provide advertising access and listing tools.
Facilitate property exposure, including portal access where applicable.
Provide optional paid subscription services.
We do not:
Act as estate agents.
Negotiate sales.
Provide legal advice.
Guarantee a sale.
Provide regulated property services.
Users remain fully responsible for managing their own sale, compliance, communications, and legal obligations.
You confirm that:
You are at least 18 years old.
You are legally entitled to market the property listed.
All information submitted is accurate and not misleading.
We reserve the right to remove listings at our sole discretion.
Certain services operate on a recurring subscription basis.
By subscribing, you:
Authorise OFF AGENT LTD to charge your payment method on a recurring basis.
Acknowledge that subscriptions renew automatically at the end of each billing period unless cancelled before the renewal timestamp.
Accept that renewal dates and billing frequency are clearly displayed within your account dashboard.
Subscriptions continue until cancelled in accordance with Section 4.
Subscriptions must be cancelled via the user dashboard within your account area.
The cancellation process is available at all times within the subscription management section.
Cancellation must be completed before the renewal date and time displayed within your account dashboard.
If cancellation is completed after the renewal timestamp, the cancellation will apply to the following billing cycle.
Email requests to cancel are not guaranteed to be processed before renewal unless confirmed in writing by Off Agent prior to the renewal timestamp.
Users remain responsible for ensuring cancellation is completed through their dashboard before renewal.
Upon successful cancellation, a confirmation message will be displayed. Users are responsible for retaining confirmation records.
All subscription payments and renewal charges are non-refundable once processed.
Exceptions may be made at our sole discretion where:
A verified system malfunction prevented cancellation prior to renewal; and
The malfunction is demonstrably attributable to Off Agent’s platform.
User-side issues including but not limited to:
Internet connectivity
Device malfunction
Browser incompatibility
Failure to log in
Forgotten passwords
do not constitute platform malfunction.
While we aim to provide continuous access, we do not guarantee uninterrupted or error-free service.
Users are responsible for:
Ensuring access to their account prior to renewal;
Maintaining login credentials;
Using supported devices and browsers.
Off Agent shall not be liable for losses arising from user-side technical issues.
Where Off Agent provides portal exposure services:
Listings are submitted subject to portal compliance rules.
We reserve the right to refuse portal submission if it may breach portal membership terms.
We do not guarantee acceptance or continued publication on third-party portals.
Self-employed individuals may list via Off Agent provided they are not operating as an estate agency business or part of a property rental scheme in breach of portal rules.
We reserve the right to suspend or remove users suspected of breaching portal compliance requirements without refund.
Users must not:
Provide false or misleading property information.
Upload harmful, unlawful, pornographic, violent, or defamatory content.
Misrepresent themselves as estate agents through the platform.
Use the platform to operate an agency business in breach of portal compliance.
We reserve the right to remove content without notice.
To the maximum extent permitted by law:
Off Agent shall not be liable for:
Failure to sell a property;
Market conditions;
Third-party portal actions;
Buyer conduct;
Legal disputes between users.
Our total liability shall not exceed the total fees paid by the user in the preceding 3 months.
Nothing excludes liability for death, personal injury, or fraud.
Initiating a chargeback for a valid subscription renewal where:
Auto-renewal was disclosed; and
Cancellation was available prior to renewal
may constitute breach of contract.
We reserve the right to:
Provide evidence to payment processors;
Recover disputed sums via lawful means where appropriate.
We process personal data in accordance with our Privacy Policy and UK GDPR obligations.
We reserve the right to amend these Terms at any time.
Updated Terms will be published on the website and apply from publication.
These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
