Welcome to Off Agent. These Terms and Conditions govern your use of our website, services, and platform (“Platform”) provided by OFF AGENT LTD (Company number 13732300), registered at Lower Wootton House, Wootton, Almeley, Hereford, HR3 6PX.
By using our Platform, you agree to be bound by these Terms. If you do not agree, you must not use our services.
1. About Off Agent
Off Agent is a digital listing platform that allows:
Individuals to list properties for sale without using a traditional estate agent.
Self-employed agents and developers to list properties for a fixed fee.
Listings to be promoted on major portals (e.g. Rightmove, Zoopla) via additional paid services.
Off Agent does not act as an intermediary, estate agent, or offer legal/financial advice.
2. Your Responsibilities
You agree to:
Provide accurate, lawful, and non-misleading content for listings.
Ensure that any property you list is your legal right to sell or market.
Conduct your own due diligence and comply with applicable legal obligations (e.g. AML, conveyancing).
Manage your own Stripe billing/subscription account.
3. Content Review and Platform Use
All listings are subject to review and approval by Off Agent before being published.
We reserve the right to reject or remove content we deem misleading, illegal, harmful, violent, pornographic, or otherwise inappropriate.
Repeat violations may lead to suspension or removal of your account.
4. Payments, Cancellations, and Refunds
All listing services and portal uploads are paid in advance. Payment secures your access to the service, not the duration a listing remains live.
If you choose to remove or withdraw your property for any reason after going live — including before the listing expires — no refund will be issued.
If you purchase multiple listing slots or services, you will be charged for all, even if only some are used.
You may cancel an active subscription at any time through your account dashboard, but we do not issue pro-rata refunds for unused time or unlisted properties.
Exceptions may only be made at Off Agent’s sole discretion in the case of a verified platform error or service failure.
5. Disclaimers
Off Agent is not liable for the success or failure of your property sale.
We do not verify listings beyond basic content checks. It is your responsibility to ensure accuracy and legal compliance.
Portal listing times may vary due to the review process or third-party platform requirements.
6. Prohibited Use
You must not use the Platform to:
Upload or distribute explicit, violent, defamatory, or illegal content.
Impersonate another person or misrepresent your authority.
Circumvent or abuse the payment or listing system.
7. Termination
We reserve the right to suspend or terminate your access to the Platform if you breach these Terms.
8. Changes to These Terms
We may update these Terms from time to time. Continued use of the Platform means you accept the revised terms.
9. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English courts.
